危险驾驶论文：危险驾驶 社会危害性 危险驾驶罪

【中文摘要】交通运输业的繁荣对于推动社会进步起着非常重要的作用,然而,事物总是利弊并存的。与此相伴随的是重大、恶性交通事故频频发生,严重危害了广大人民群众的生命和财产安全。面对严峻的交通安全形式,刑法修正案(八)出台,将醉酒驾车和飚车行为纳入刑法的规制范围。但是本文认为醉酒驾车和飚车行为只是造成交通事故的原因之一,其他的危险驾驶行为,才是造成交通事故的主因。因此,本文对刑法修正案(八)提出质疑,认为其主观方面应为间接故意且所处法定刑过低,主张设立危险驾驶罪,将包括醉酒驾车和飚车行为在内的危险驾驶行为一并纳入危险驾驶罪。本文一共分为五部分,第一部分在于说明我国交通事故的现状以及立法方面存在的不足,说明我国增设危险驾驶罪的必要性。第二部分主要探讨危险驾驶的国(境)外相关立法现状,说明我国增设危险驾驶罪的可行性,提出对我国的借鉴意义。第三部分介绍我国专家学者对危险驾驶行为入罪的不同观点,并提出自己的观点,即提出增设危险驾驶罪。第四部分从危险驾驶的社会危害性、犯罪构成、符合国际刑事政策动向等方面为危险驾驶入罪提供理论支撑。第五部分,阐述危险驾驶入罪的立法构想,通过对危险驾驶行为构成要件的基本分析以及参考国外立法,提出了相应的法定刑设计。

【英文摘要】The prosperity of transportation plays a pivotal role in promoting social progress. However, every coin has two sides. It meanwhile leads frequently traffic accidents, especially major and vicious ones. People’s lives and property have been seriously harmed. Faced with increasingly severe traffic safety situation, the Amendment to the Criminal law of the people’s republic of China (Ⅷ) has been passed and written the Drunk Driving and Racing behaviors into Criminal Law. But the paper insists that the behavior of drunk driving and racing is just one of the reasons causing traffic accidents, and the most important reason for traffic accidents is dangerous driving. In this paper, the Criminal Law has been questioned. Subjective aspects that should be indirect intention and legal punishment which is too low, and we should write the dangerous driving into Criminal Law which includes Drunk Driving and racing behaviors. This dissertation is mainly composed of five parts. The first part will be devoted to examine the status of China’s traffic safety and legislative gaps, which proves the necessity of establishing the crime of dangerous driving. In the second part, we will analyze the legislative model of other countries and regions, which proves the feasibility of establishing the crime of dangerous driving and make references to our country. The third part is mainly introducing the different opinions of experts about dangerous behavior and put forward my view which writes the dangerous driving into Criminal Law. The four part will lay down the theoretical foundation for convicting the dangerous driving in several parts, such as Serious social harm of the dangerous driving、accordance with the movements of criminal policy、Constituent Conditions of the crime of Dangerous driving. The five parts will propose a legislative formulation of the crime of dangerous driving, which will be presented on the basis of analyzing the constituents of this crime and reference to foreign legislation. The Legal Penalty Arrangement of the Crime of Dangerous driving in our country will be proposed at the last of this paper.
